Immigration laws are very complex and change frequently. If you are a foreign national and you make an error concerning your legal status in the United States, you could find yourself forced to leave the United States and legally barred from returning. That is why it is critical that you know the United States immigration laws and comply with them.
Family based Immigration
If you are a person born in another country and are married to a United States Citizen or Lawful Permanent Resident of the United States, or have other relatives who are United States Citizens or Lawful Permanent Residents, we may be able to help you obtain permanent residence, which will allow you to live and work in the United States.
What we can do...
The United States Bureau of Citizenship and Immigration Services (USBCIS) requires substantial documentary evidence establishing that a marriage between a United States citizen and an alien was not entered into solely for the purpose of obtaining permanent residence for the alien before a visa petition by a spouse can be approved. We can assist you with evaluating your documentation and determining what additional documents may be needed. It is important to have legal assistance, because your petition could be denied and you could be forced to leave the United States if all requirements are not met.
Employment Based Immigration
If you are an employer seeking to hire a foreign national, we can assist you with preparing a temporary visa petition or a labor certification application to obtain permanent residence for your employee.
What we can do...
Employment based immigration requires clear definition of job duties and requirements. We can make certain you are offering a position that will allow you to obtain an immigration benefit for your employee and that you do not impose job requirements that are not permitted United States laws. Labor Certification procedures require strict compliance with job advertising and recruitment efforts to determine if there are any United States workers able to fill your position. We can work with you to make sure you comply with all legal requirements for these procedures.
Immigration Defense
If you are placed in proceedings to remove you from the United States, you have very limited legal protection. You could find yourself forced to leave the United States and permanently barred from returning.
What we can do...
We can determine if you have any defense to being removed from the United States and assist you with preparation of applications for relief. If your immigration problem stems from a criminal conviction, we can determine if it is possible to reopen your criminal conviction. We can also attempt to adjourn your immigration proceedings until we have reopened and vacated your criminal conviction.
Federal Court Appeals and Petitions
If you are subject to an adverse determination on your immigration case, you may be able file an appeal or a petition to a United States Federal Court.
What we can do...
We can determine if you have grounds to challenge an order of removal or deportation in a Federal Court. If you are being held in detention for immigration purposes, you may have rights to appeal a decision denying your release to a Federal Court. We can determine if any steps, other than commencing an action in a Federal Court, are available. If a Federal Court action is the most appropriate procedure, we can file all necessary paperwork and appear at any hearings or oral arguments held in connection with your case.
Unauthorized Practice of Law
There are many non-attorneys, including "notarios" and "immigration consultants" who will offer to assist you with immigration matters. These persons do not have legal training, and often do not have a full understanding of the consequences of decisions they make. More important, they are NOT subject to the professional regulation and safeguards of attorneys. If you utilize one of these services, and they make an error that jeopardizes your immigration status, you may be left with no relief. Do NOT trust your immigration status to a non-attorney!
